Response Paper Regarding Changes to the Nonprofit Legal Framework in Ontario (2008)
The first project of the emerging Ontario Nonprofit Network (ONN)is to provide an analysis and response to the Ontario government’s recent process to modernize the nonprofit legal framework in Ontario. Through the work of an Expert Working Group, the ONN has released a brief regarding Consultation Paper #1 and #2.
The Ontario Nonprofit Network (ONN) is a diverse group of public benefit organizations. The impetus for this joining together in mid 2007 was the publication of the first consultation paper* by the Policy and Consumer Protection Services Division, Ministry of Government Services, proposing to modernize the Ontario Corporations Act that affects nonprofits in this province. {*“Modernization of the Legal Framework Governing Ontario Not-For-Profit Corporations”}
In addressing the Corporations Act consultation papers, we have assembled individuals with a wide diversity of views, perspectives and expertise from the nonprofit sector, in partnership with some legal experts in nonprofit law to form an Expert Working Group. This group is charged with examining the consultation documents and legislative reform proposals from the (now) Ministry of Government and Consumer Services, providing feedback to MGCS and providing the sector with advice and comments.
This legislation is critical for the sector’s long-term well-being. Please participate in the consultation process by making your views known. The Ministry’s documents can be found on the Government of Ontario website http://www.gov.on.ca/MGCS/en/AbtMin/132784.html
The response brief from ONN, designed to assist you from the public benefit, nonprofit sector perspective, will soon be posted on a new website currently in development. http://www.Ontariononprofitnetwork.ca.

The greater the number of organizations who participate, the greater the likelihood we will obtain workable legislation. It has been 50 years since the last major revision of this legislation; the nonprofit sector cannot afford to miss this opportunity.
| It is not too late to participate in the consultation processeven though the official response deadlines have passed for the Ministry of Government and Consumer Services Papers 1 and 2. A quick response method is to copy the recommendations summarized in the Report of the Ontario Nonprofit Network’s Expert Working Group and add your comments under each recommendation. |
